Mayor Whipple opened the public hearing at
Norm Austin, First United Methodist Church
Chairperson of the Building Committee and Lay Leader, and Sr. Pastor Huntley
were in attendance as proponents for the
request to vacate the alley north of the church between Rogers and Barnes
Streets. Mr. Austin gave a brief
description of the proposed expansion, landscaping, parking lot, and day
care. The property north of the church

Mayor Whipple referenced a letter opposing the alley vacation submitted by Councilmember Bruno.

WHEREAS, the City Council of the City of Mason on
February 3, 2002, adopted Resolution 2003-09 deeming it advisable and
necessary for the health, welfare, comfort, and safety of the people of the
City of Mason to discontinue and vacate the following platted public alley:
That certain east-west
alley running east from Barnes Street to Rogers Street as described in Block 12
of the Original Plat of the City of Mason, being all of that certain alley
abutting Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, and 12 of Block 12 of the
Original Plat of the City of Mason, Ingham County, Michigan.
and;
WHEREAS, a Notice of Hearing on the proposed vacation of the
above-described premises was published in the Ingham County Community News, a
weekly newspaper published and circulated in the City of Mason, Michigan,
during the four consecutive weeks of February 9, 2003, February 16, 2003,
February 23, 2003, and March 2, 2003, establishing the time and place
of the Public Hearing as the 17th day of March, 2003, at the Council Chambers
at 201 West Ash Street, Mason, Michigan, at 7:30 p.m.; and
WHEREAS, the Public Hearing on the vacation of the
above-described premises was held on this 17th day of March, 2003, at the
Council Chambers in the City of Mason by the City Council;
NOW THEREFORE, IT IS RESOLVED, that, pursuant to its authority
granted by the Charter of the City of Mason and the statutes of the State of
Michigan, to wit: the Fourth Class
Cities Act, MCL 102.3, MSA 5.1808, and the Michigan Land Division Act, MCL
450.257, MSA 526.430 (257), the City Council of the City of Mason, hereby
vacates and discontinues the above-described portions of the platted public
alley in Block 12.
RESERVING HOWEVER, unto the City of Mason the right to an
easement in the City of Mason for public utility purposes and other public
purposes, including the right to maintain and continue any and all existing
public or quasi-public utility easements, and the right hereafter to install
and maintain any public or quasi-public utility easements thereover,
or thereunder, and the right of ingress and egress
thereto for any purpose whatsoever, including installation of cable for cable

Street, Mason, Michigan, on Monday, the 17th day of March, 2003, at 7:30 p.m.

The following resolution was offered by Helbig
and supported by Johnson:
WHEREAS, pursuant to due notice to all interested
parties, this City Council did meet on Monday, March 17, 2003, in the City
Hall, 201 West Ash Street, Mason, Michigan, for the purpose of reviewing the
special assessment roll and hearing any objections thereto for Sidewalk Special
Assessment District - 2003-1; and
WHEREAS, at the time and place designated for said
meeting, the meeting was duly called to order and the opening of the hearing
for objections to the special assessment roll, prepared by the City Assessor
and on file with the City Clerk, was announced, said roll assessing the cost of
certain sidewalk improvements against the benefiting properties; and
WHEREAS, objections were heard or filed in writing with
the City Clerk and the following adjustment or corrections, if any, were made:

WHEREAS, the City Council now desires to confirm the
special assessment roll attached hereto as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED THAT:
1.
The City
Council hereby designates the special assessment district as the “Sidewalk Special
Assessment District - 2003-1.”
2.
The special assessment roll as prepared and reported to the
City Council by the City Assessor shall be designated as the “Sidewalk Special
Assessment District - 2003-1 Special Assessment Roll” in the final amount of $11,920.51,
and is hereby adopted and confirmed, and the City Clerk is hereby directed to
endorse thereon this date of confirmation.
3.
The special assessment roll shall be divided into three (3)
equal annual installments. The first
installment shall be due on July 1, 2003, and the two (2) subsequent
installments shall be due on July 1 of the succeeding years thereafter. Special assessments may be paid in full on or
before August 31, 2003, without interest.
Thereafter, installments of the special assessment roll shall bear
interest at the rate of six percent (6%) per annum, commencing on

Any of the unpaid balance due on the special assessment roll
may be paid in full on any installment date, together with interest due to said
payment date.
5.
The assessments made in said special assessment roll are
hereby ordered and directed to be collected.
The City Clerk shall deliver the special assessment roll to the City
Finance Director/Treasurer with the proper warrant attached, commanding the
City Finance Director/Treasurer to collect the assessments therein in
accordance with the directions of the City Council with respect thereto, and
the City Finance Director/Treasurer is authorized and directed to collect the

and the provisions of the applicable statutes of the State of Michigan.
6.
All resolutions and parts of resolutions insofar as they
conflict with the provisions of this resolution be,
and the same are, hereby rescinded.

presented a proclamation to the Mason Council 9182 of the Knights of Columbus
of the St. James Catholic Church in recognition of honors bestowed upon them
and declared Monday, March 17, 2003 as “Mason Council 9182 of the Knights of
Columbus Day.”

use the city’s right-of-way and sidewalks for a fund raiser on Friday, April 11th

Discussion - Government Cable Channel 21
Discussion was held regarding the recent complaints citing audio problems on Channel 21.
It was determined that the lack of audio was due to a faulty tape turned
in by one of the local churches. It was also noted that at the
beginning of live broadcasts, the sound is not turned on until the meeting
officially begins.

Council Member Clark provided flags to be
displayed at each member’s seat and asked that a resolution be presented at the
