The meeting was called to order at 7:33 p.m. by Mayor Whipple.

Mayor Whipple led the Pledge of Allegiance and offered the invocation.

 

APPROVAL OF MINUTES - REGULAR COUNCIL MEETING: March 3, 2003

The Minutes of March 3, 2003 were approved as submitted.

REGULAR BUSINESS

Public Hearing - Alley Vacation North/Adjacent to the Methodist Church

Mayor Whipple opened the public hearing at 7:37 p.m.

 

Norm Austin, First United Methodist Church Chairperson of the Building Committee and Lay Leader, and Sr. Pastor Huntley were in attendance as proponents for the request to vacate the alley north of the church between Rogers and Barnes Streets.  Mr. Austin gave a brief description of the proposed expansion, landscaping, parking lot, and day care.  The property north of the church on Barnes Street was purchased and is planned for a prayer garden and fenced playground.  Easement agreements for alley access and maintenance have been made between the church and abutting property owners.  The Planning Commission approved the Special Use Permit and Preliminary Site Plan on March 11, 2003, subject to the alley vacation.  No objections were indicated when he spoke with Police Chief McCormick, Fire Chief Scutt, DPW Director Dean, and Supervisor of Streets, Ken Baker regarding the requested alley vacation.     


 

Mayor Whipple referenced a letter opposing the alley vacation submitted by Councilmember Bruno.

 

Mayor Whipple closed the public hearing at 7:45 p.m.

 

Resolution No. 2003-16 - Vacating the Alley in block 12 of the Original Plat of the

City of Mason, Ingham County, Michigan

 

Resolution No. 2003-16 was introduced by Johnson and seconded by Helbig.

 

Discussion was held on amending Resolution No. 2003-16.

To amend Resolution No. 2003-16 by striking, and whereas, no objections were made to said vacation of the premises from the third WHEREAS.

RESOLUTION NO. 2003-16

 

A RESOLUTION VACATING THE ALLEY IN BLOCK 12 OF THE ORIGINAL PLAT OF THE CITY OF MASON, INGHAM COUNTY, MICHIGAN.

 

      Moved by:         Johnson

      WHEREAS, the City Council of the City of Mason on February 3, 2002, adopted Resolution 2003-09 deeming it advisable and necessary for the health, welfare, comfort, and safety of the people of the City of Mason to discontinue and vacate the following platted public alley:

 

That certain east-west alley running east from Barnes Street to Rogers Street as described in Block 12 of the Original Plat of the City of Mason, being all of that certain alley abutting Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, and 12 of Block 12 of the Original Plat of the City of Mason, Ingham County, Michigan.

 

and;

 


      WHEREAS, a Notice of Hearing on the proposed vacation of the above-described premises was published in the Ingham County Community News, a weekly newspaper published and circulated in the City of Mason, Michigan, during the four consecutive weeks of February 9, 2003, February 16, 2003, February 23, 2003, and March 2, 2003, establishing the time and place of the Public Hearing as the 17th day of March, 2003, at the Council Chambers at 201 West Ash Street, Mason, Michigan, at 7:30 p.m.; and

 

      WHEREAS, the Public Hearing on the vacation of the above-described premises was held on this 17th day of March, 2003, at the Council Chambers in the City of Mason by the City Council;

 

      NOW THEREFORE, IT IS RESOLVED, that, pursuant to its authority granted by the Charter of the City of Mason and the statutes of the State of Michigan, to wit:  the Fourth Class Cities Act, MCL 102.3, MSA 5.1808, and the Michigan Land Division Act, MCL 450.257, MSA 526.430 (257), the City Council of the City of Mason, hereby vacates and discontinues the above-described portions of the platted public alley in Block 12.

     

      RESERVING HOWEVER, unto the City of Mason the right to an easement in the City of Mason for public utility purposes and other public purposes, including the right to maintain and continue any and all existing public or quasi-public utility easements, and the right hereafter to install and maintain any public or quasi-public utility easements thereover, or thereunder, and the right of ingress and egress thereto for any purpose whatsoever, including installation of cable for cable television and telecommunications networks.

SPECIAL ASSESSMENT RESOLUTION NO. 5

PROJECT 2003-1

 

      At a regular meeting of the City Council of the City of Mason, Ingham County, Michigan (the “City”), was held in the City Hall, 201 West Ash Street, Mason, Michigan, on Monday, the 17th day of March, 2003, at 7:30 p.m.

 

      The meeting was called to order at 7:30 p.m. by Mayor Whipple.

           

      Present:      Council Members - Preadmore, Clark, Helbig, Johnson, Naeyaert, Whipple

      Absent:       Council Members - Bruno

 

      The following resolution was offered by Helbig and supported by Johnson:

 

      WHEREAS, pursuant to due notice to all interested parties, this City Council did meet on Monday, March 17, 2003, in the City Hall, 201 West Ash Street, Mason, Michigan, for the purpose of reviewing the special assessment roll and hearing any objections thereto for Sidewalk Special Assessment District - 2003-1; and

 

      WHEREAS, at the time and place designated for said meeting, the meeting was duly called to order and the opening of the hearing for objections to the special assessment roll, prepared by the City Assessor and on file with the City Clerk, was announced, said roll assessing the cost of certain sidewalk improvements against the benefiting properties; and

 

      WHEREAS, objections were heard or filed in writing with the City Clerk and the following adjustment or corrections, if any, were made:

 

; and

     

      WHEREAS, the City Council now desires to confirm the special assessment roll attached hereto as Exhibit A.

 

      NOW, THEREFORE, BE IT RESOLVED THAT:

 


1.                               The City Council hereby designates the special assessment district as the “Sidewalk  Special Assessment District - 2003-1.”

 

2.                   The special assessment roll as prepared and reported to the City Council by the City Assessor shall be designated as the “Sidewalk Special Assessment District - 2003-1 Special Assessment Roll” in the final amount of $11,920.51, and is hereby adopted and confirmed, and the City Clerk is hereby directed to endorse thereon this date of confirmation.

 

3.                   The special assessment roll shall be divided into three (3) equal annual installments.  The first installment shall be due on July 1, 2003, and the two (2) subsequent installments shall be due on July 1 of the succeeding years thereafter.  Special assessments may be paid in full on or before August 31, 2003, without interest.  Thereafter, installments of the special assessment roll shall bear interest at the rate of six percent (6%) per annum, commencing on September 1, 2003, payable annually on the due date of each installment after the first installment.  If any installment is not paid when due then the same shall be deemed to be delinquent and there shall be collected thereon in addition to the interest above provided, a penalty at the rate of one percent (1%) for each month or fraction thereof that the same remains unpaid before being reported for reassessment upon the City tax roll.  In the event the City Council determines that it is in the best interest of the district and the City at large to issue bonds pledging the receipts of said special assessment roll and the full faith and credit of the City; then and in that event, the interest on the unpaid installments shall be adjusted to not more than one percent (1%) greater than the average interest rate at which the bonds were sold.  Said interest shall be payable annually on each installment due date.

4.                   Any of the unpaid balance due on the special assessment roll may be paid in full on any installment date, together with interest due to said payment date.

 

5.                   The assessments made in said special assessment roll are hereby ordered and directed to be collected.  The City Clerk shall deliver the special assessment roll to the City Finance Director/Treasurer with the proper warrant attached, commanding the City Finance Director/Treasurer to collect the assessments therein in accordance with the directions of the City Council with respect thereto, and the City Finance Director/Treasurer is authorized and directed to collect the amounts assessed as they become due pursuant to the terms of this resolution and the provisions of the applicable statutes of the State of Michigan.

 

6.                   All resolutions and parts of resolutions insofar as they conflict with the provisions of this resolution be, and the same are, hereby rescinded.

A RESOLUTION RECOGNIZING NATIONAL COUNTY GOVERNMENT WEEK AND THE POSITIVE CONTRIBUTIONS  OF INGHAM COUNTY, MICHIGAN

March 17, 2003

 


WHEREAS, the National Association of Counties has declared the week of April 6-12, 2003 as National County Government Week; and

 

WHEREAS, National County Government Week was initiated in 1990, to raise public awareness and provide citizens with a better understanding of how counties respond to their needs; and

 

WHEREAS, this year’s theme for National County Government Week is “Counties Care for Kids”; and

 

WHEREAS, Ingham County government continually demonstrates a commitment to provide services and protection for the most vulnerable people in our society, including the young, the old, and families affected by economic change; and

 

WHEREAS, Ingham County promotes a healthy “Quality of Life”, by ensuring that basic health needs are met and that recreational facilities are provided to support healthy life styles; and

 

WHEREAS, the City of Mason is proud to be the County Seat of Ingham County, which allows a first hand view of the many good works that the County Elected Officials and staff provide on a daily basis.

 

NOW THEREFORE BE IT RESOLVED, that the Mason City Council does hereby recognize and honor the government of Ingham County by declaring the week of April 6-12, 2003 as National County Government Week, in and for the City of Mason.

A RESOLUTION DETERMINING THE NECESSITY AND ADVISABILITY OF VACATING THAT PORTION OF RAYNER STREET NORTH OF RANDOLPH STREET PLATTED ACCORDING TO THE PLAT OF GRIFFIN’S ADDITION TO THE CITY OF MASON, INGHAM COUNTY, MICHIGAN.

      WHEREAS, it is deemed advisable and necessary for the health, welfare, comfort and safety of the people of the City of Mason to discontinue and vacate the following platted public street:

 


That portion of Rayner Street lying north of Randolph Street, as described in the Plat of Griffin’s Addition to the City of Mason dated December 7, 1869, which street is more particularly described as follows:

 

Commencing at the southeast corner of Lot 8 of Block 8 of Griffin’s Addition to the City of Mason according to the plat thereof dated December 7, 1869, recorded at Liber 45 of Deeds, Pages 316-318, being a plat of part of Section 4, T2N, R1W, Ingham County, Michigan,  thence north to the northeast corner of said Lot 8, thence east to the northwest corner of Lot 5 of Block 9 of Griffin’s Addition to the City of Mason, thence south to the southwest corner of said Lot 5, thence west to the point of beginning, being a part of the plat of Griffin’s Addition to the City of Mason, T2N, R1W, Ingham County, Michigan.

 

      WHEREAS, the City of Mason deems it advisable to reserve an easement in the above-described premises for public utility purposes and other public purposes within the right-of-way to be vacated, including an easement for installation of cable for a cable television and telecommunications networks:

 

 

      NOW THEREFORE, IT IS RESOLVED, that the Council deems it advisable and necessary for the health, welfare, comfort and safety of the people of the City of Mason, to consider a resolution to discontinue, vacate, and abolish said premises, described above, subject to the reservation of an easement in the City of Mason for public utility purposes and other public purposes including the right to maintain and continue any and all existing public or quasi-public utility easements thereover or thereunder, and the right of ingress and egress thereto for any purpose whatsoever; and,

     

      IT IS FURTHER RESOLVED, that this Council will meet at 7:30 p.m., on the 5th day of May, 2003, in the City Council chambers at 201 West Ash Street, Mason, Michigan for the purposes of hearing objections thereof; and,

 

      IT is FURTHER RESOLVED, that the City Clerk is directed to give notice of such hearing by publication of a copy of this Resolution in the Ingham County Community News, a weekly newspaper published and circulated in the City of Mason, at least once each week for not less than four (4) consecutive weeks, preceding such hearing.

Mayoral Proclamation


Mayor Whipple informed the body that he presented a proclamation to the Mason Council 9182 of the Knights of Columbus of the St. James Catholic Church in recognition of honors bestowed upon them and declared Monday, March 17, 2003 as “Mason Council 9182 of the Knights of Columbus Day.”

 

Request - Knights of Columbus - Use of Right-of-Way

The Knights of Columbus are requesting to use the city’s right-of-way and sidewalks for a fund raiser on Friday, April 11th to Sunday, April 13th.

To approve the Knights of Columbus request to raise donated funds in the city’s right-of-way/sidewalks on April 11-13 of 2003 subject to no solicitation on the streets.

Mayor Whipple commented on the matter of conduct of business by city boards and commissions.  Discussion followed on establishing a course of action to educate all members on the importance of adhering to the established rules of order.

Discussion - Government Cable Channel 21

Discussion was held regarding the recent complaints citing audio problems on Channel 21.  It was determined that the lack of audio was due to a faulty tape turned in by one of the local churches.  It was also noted that at the beginning of live broadcasts, the sound is not turned on until the meeting officially begins.

NEW BUSINESS

Council Member Clark provided flags to be displayed at each member’s seat and asked that a resolution be presented at the next council meeting indicating support of the military efforts.  The Mason American Legion Post is adopting his daughter’s recently dispatched reserve unit that was recently called out and he will send a copy of the resolution in the correspondence to them.

 

Mayor Pro tem Helbig informed the council that she would be representing the City of Mason at the MML Legislative Conference in Lansing.  Council Member Naeyaert indicated that she will also be attending the conference.

Council Member Johnson informed the council that the Special Use Permit for the First United Methodist Church was approved at the March 11, 2003 meeting as well as the preliminary site plan for the Mason Business Center.

Administrator Colburn informed the council that the Capital Region Airport Authority (CRAA) held a public meeting March 13, 2003 to discuss the application request for a north/south sod runway at Mason-Jewett Field.  The meeting was well attended by pilots and residents.  Although the CRAA presented the meeting as informational and said they were soliciting input from local officials, it appeared that the plan had been previously prepared.  Community leaders from Mason had not been invited or formally notified of the meeting.  The summary of the findings provided by Soil and Materials Engineers, Inc. for the subsurface evaluations indicate that groundwater monitoring wells will need to be installed at the former Mason Firehouse after renovations are completed.
